Terms And Conditions
This contract will exist between you (the customer) and ourselves..
DEPOSITS
At the time of booking a refundable deposit of £10.00 per item is required to be paid to secure your booking, and also counts as a security deposit, this deposit will be returned in full to you once the hire period has terminated and we have had opporunity to fully inspect the hired item(s) and confirm they have been returned in the condition supplied.
Any loss, damage or soiling of the hired items will result in loss of your deposit for that item, note that we will require full compensation for any loss, damage or soiling and where this amount exceeds the deposit you will be liable in law to make good any shortfall.
CANCELLATIONS
The above deposit will be retained if you cancel your booking within 14 days of commencement of the hire period, if we are able to hire the goods out for the same time period as the cancelled dates then this deposit will be refunded, however, if we are unable to replace that booking you will lose your deposit.
In the event of cancellation any hire charges paid by the customer will be refunded in full , however if Nursery Hire UK incurr any unusual expences as a result of the cancellation the company reserves the right to deduct these from the hire fee and return the remainder to the customer within 7 days.
DELIVERY AND COLLECTION
Our charges are free delivery & collection within a five mile radius of your chosen branch (minimum spend of £20.00 applies) or £5.00 up to five additional miles for each delivery and collection journey. Rates are negotiable
PAYMENTS
We accept Cheque's, Postal Orders or Cash, Card payments must be telephoned to your chosen branch.

THE HIRER SHALL. —
1- Accept that responsibility of the equipment and its correct use following guidance and instructions given is that of the customer.
Nursery Hire UK or their agent will not be liable for accidents incurred during the rental of any equipment, Children should be supervised at all times when using equipment etc.
(a) Collect the Goods from Nursery Hire UK representative or premises aforesaid at the beginning of the hiring and return to them thither at the termination thereof.
(b) Pay the said hire in advance on the signing of this agreement.
(c) Use the Goods only for the purpose for which they are designed.
(d) Maintain the Goods in the same working condition and appearance and state of repair as they now are and in default of so doing pay to the Owner on demand the cost of putting the same in such condition appearance and state of repair howsoever any damage may be caused.
(e) In the event of loss of the Goods or any item thereof from whatsoever cause forthwith pay to the Owner the cost of replacement thereof which cost is indicated in the Schedule hereto.
(f) Not part with the possession of the Goods or any item thereof.
(g) Not attempt to assign the benefit of this agreement.
(h) Immediately on request advise the Owner of the whereabouts of the Goods.
(i) Not pledge the Goods or any item thereof nor allow the same to be taken in execution.
(j) Return the Goods to Nursery Hire UK representative or premises aforesaid upon the date of termination of the hiring and in default of so doing pay to the Owner by way of liquidated Damages in respect of each subsequent day a sum equivalent to the hire rent payable in respect of each day during the period of the hiring. Such sums to be paid without prejudice to the Owner’s right to greater Damages for such default in the event of greater loss.
(k) Responsibility for insurance and liability for, loss or damage to equipment and users rests entirely with the customer.
2 - This agreement shall determine forthwith (without prejudice to any antecedent claim of the Owner) and the Goods may forthwith be repossessed by the Owner in any one or more of the following events: -
(a) The Commission by the Hirer of an act of bankruptcy or his entry into any agreement with his general body of creditors.
(b) The breach by the Hirer of any stipulation herein contained and on his part to be observed and performed.
3 - The Hirer hereby declares: -
(a) That he is of eighteen years of age or more.
(b) That he is otherwise legally entitled to enter into this agreement on his own or (if he shall enter into the same on behalf of another individual or on behalf of other individuals or a limited Company) that he has full authority to do so.
SETTLEMENT TERMS
Unless specified otherwise on the invoice settlement terms are 14 days in advance of the commencement of the hire period, or if agreed, immediately upon termination of the hire period, after this time accounts become overdue.
The Company reserves the right to charge interest on any overdue account at the rate of 2% per month.
The Company will also be entitled to reimbursement of all external or additional costs and expenses reasonably incurred in the enforcement of its rights under this clause including but not limited to, the payment of agency and legal fees and expenses whether incurred before or after the legal proceedings.
